BY USING YOUR XPERTSEA PRODUCT, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE XPERTSEA ONE (1) YEAR LIMITED WARRANTY (“WARRANTY”) AS SET OUT BELOW.
XpertSea warrants the XperCount2 and its accessories ("Equipment") against defects in materials and workmanship for a Warranty Period of one (1) year. The warranty period begins on the date the Equipment is delivered and continues for twelve (12) months ("Warranty Period"). The Warranty Period also includes technical support and software upgrades.
The foregoing warranty is subject to the proper installation, operation and maintenance of the equipment in accordance with instructions provided in the User's Guide. XpertSea does not warrant against normal wear and tear, nor damage caused by accident, abuse, misuse, misapplication, storage damage, negligence or modification to the Equipment or any of its components.
ALWAYS CHARGE EQUIPMENT FROM A GROUNDED WALL OUTLET. DAMAGES RESULTING FROM NON-GROUNDED CHARGING ARE NOT COVERED BY OUR STANDARD WARRANTY. DO NOT ATTEMPT TO DISASSEMBLE OR TAMPER WITH THE ELECTRONIC MODULE. XPERTSEA DOES NOT WARRANT THE MODULE IF IT HAS BEEN DISASSEMBLED OR MODIFIED BY THE CUSTOMER.
Warranty claims must be made by the original Customer in writing within thirty (30) days of the first manifestation of a problem. To submit a claim, contact XpertSea customer support by email at firstname.lastname@example.org or by phone at +1 (581) 981-9811. Call charges may apply depending on your location. You may be required to furnish proof of purchase details when making a claim under this warranty. XpertSea’s sole obligation under the foregoing warranty is, at XpertSea’s option and discretion, to repair, replace or correct any such defect that was present at the time of delivery, or to remove the equipment and to refund the purchase price to the customer.
Any repairs under this warranty must be conducted by an authorized XpertSea service representative. XpertSea is responsible for the shipping of the replaced or repaired parts under warranty. The Customer shall enclose the Return Merchandise Bond provided by XpertSea with the Equipment to be returned to XpertSea’s office. For any return under warranty, the Customer shall follow the instructions provided by XpertSea.
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL XPERTSEA, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA OR OTHER INTANGIBLE LOSSES THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE, WHETHER OR NOT XPERTSEA HAS BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
XpertSea offers an extended warranty which includes priority technical support and automatic replacement of any faulty parts in the event of a malfunction, among other exclusive benefits. The extended warranty can be purchased on a year by year basis.
